Terms and Conditions:*On-Line & Print 1.This is a non-cancellable 14 days after date of contract. The advertiser is granted the right to cancel the contract if said cancellation is received by the publisher within fourteen (14) days of the contract date via Certified Mail, less paid agent’s commission. Both parties shall not be bound by oral agreements neither contrary to nor in addition to the terms and conditions as stated herein and no agent or employee of publisher has authority to vary any of the terms of this application. 2.Applicant agrees to pay Discover the Region (DTR) for the advertising on the Advertising contract 30 days after being billed. 3.Applicant hereby warrants that he/her is duly authorized to sell the product or service shown in the copy submitted for the advertisement or listing, and that he/she has the right to use and advertise the trademark, service mark or trade name featured therefore. 4.No Terms whether implied or verbal are to be considered a part of this contract unless made a part of this contract writing 5.All listings and display ads are accepted subject to the approval of Discover the Region. 6.All online submissions and changes to DiscoverTheRegion.com are subject to approval before posting live. 7.DTR shall not be liable to the advertiser for damages resulting from failure to include any items of advertising specific in this agreement or from errors in the advertising printed in the DTR in excess of an amount equal to the agreed price for said item of advertising for the issue in which the error or omission occurs. 8.The applicant agrees to hold DTR harmless from any liability coming as the result of advertising placed in the volume specific. 9.Applicant assumes sole responsibility for the protection of its copyright in any advertising pictorial illustration, design, map, photograph, or combination thereof included in its advertisement(s). 10.All claims regarding error in copy and manner of distribution must be presented to DTR within 30 days after publication of the volume or be deemed waived. 11.A service charge of one and a half percent per month will be initiated in all statements 30 days past due (annual percentage rate is 18%). 12.If any part of this contract is void, such part shall not void the whole contract. The forum for litigation for any dispute arising hereunder shall be in the issue of the publication. Purchaser will pay for all expenses incident to collection to contract price, including a reasonable sum for attorney's fees. 13.While DTR will endeavor, on request, to show the application proof of representation, the liability of the applicant hereunder shall not be affected by failure to show such proof. 14.Upon cancellation, the customer will be held responsible for all production cost relative to advertisement on the reverse side. 15.Upon non-payment by the advertiser of any sum due, the publisher DTR may cancel this agreement without notice, and thereupon the entire amount payable during the effective period of the reverse stated volume shall immediately become payable and due.
